ECJ ruling C-55/18 (2019) and BAG decision of 13. 09. 2022 (1 ABR 22/21) oblige all employers to keep a complete record of all working hours.
A draft bill (2024/25) specifies electronic, tamper-proof recording “immediately, completely and reliably”.
Companies of any size and industry; exceptions only for genuine senior executives. Mobile working, working from home and trust-based working hours are expressly included.
Fines of up to €30,000 possible under Section 22 ArbZG; there is also a risk of back payments and damage to reputation.
