What is mobile working?
Mobile working enables employees to carry out their professional tasks regardless of their location – be it in a café, on the train or in a co-working space. In contrast to working from home, which requires a fixed workplace at home, mobile working offers maximum flexibility in terms of work location.
Differences to working from home
While the home office is a fixed workplace in the employee’s private environment, mobile working is characterized by the freedom to choose the place of work. This can be a café, a co-working space or another suitable location, for example.
Legal framework
There is no legal entitlement to mobile working in Germany. Implementation is based on an individual agreement between employer and employee.
Although the Workplace Ordinance (ArbStättV) does not apply to mobile workplaces, mobile working is still subject to the Occupational Health and Safety Act (ArbSchG) and the Working Hours Act (ArbZG). Employers are obliged to identify potential risks through risk assessments, even if these are usually carried out using questionnaires.
