Electronic signatures or e-signatures make it possible to sign digital documents in a legally valid manner and replace handwritten signatures on paper. The European eIDAS Regulation defines an electronic signature as data in electronic form that is attached to or logically associated with other electronic data and that the signatory uses to sign.

Electronic signatures can be used for all contracts, offers or written documents between two companies where the applicable law is US or EU law, unless written form is expressly required or agreed.

Electronic signatures or e-signatures with DocuSign are legally binding for almost all business transactions throughout the EU and the USA. DocuSign fulfills the strict regulations of the so-called eIDAS Regulation in the EU and the ESIGN and Uniform Electronic Transactions Act in the USA.

Electronic signatures or e-signatures are a broad category of methods for signing documents. A digital signature is a type of electronic signature that uses a specific technical implementation. Digital signature providers such as DocuSign comply with the PKI (Public Key Infrastructure) protocol. Both signatures, whether digital or electronic, make it possible to sign documents and authenticate the signatory. But the purpose, the technical implementation, the use in certain regions and the cultural and legal acceptance of signing documents digitally or electronically and authenticating the signatory vary.

DocuSign meets industry-leading best practices for securing data and transactions. Each electronic signature is unique, documentable, encrypted and tamper-proof. DocuSign ensures the confidentiality of all transactions and creates a certificate of completion for each completed transaction, providing a comprehensive audit trail of signature events. DocuSign is currently the only electronic signature provider with ISO 27001 certification. 14 days after the last signature completes the transaction, the documents are deleted from the DocuSign platform. Only the completion certificate is stored by DocuSign for a further 10 years.

DocuSign has two different data rings, each with three data centers. One ring in the USA and one in Europe with data centers in Germany, France and the Netherlands.

No additional software needs to be installed to use DocuSign. You can view, check and sign documents in DocuSign using a standard Internet browser (e.g. Internet Explorer, Firefox, Chrome, Safari). DocuSign also offers a mobile app if required.

It is always free to sign a document with DocuSign.

No, you do not need to register with DocuSign. The notification you receive via DocuSign contains a link to the documents. You can use the link to check and electronically sign the documents. If you use the DocuSign mobile app on your smartphone or tablet or want to see the status of all your transactions at a glance, you can register with DocuSign free of charge and create a DocuSign account.

ZMI uses an electronic signature as defined by the eIDAS Regulation. No further authentication is required for this form. If you receive an e-mail notification, no further authentication is required.

You will receive an e-mail notification with a link to the document and will be asked to sign it. You can use this link to open the document, check it and also sign it electronically.

With DocuSign, the recipient of an email notification clicks on a link using an internet-enabled device (such as a cell phone, tablet or computer) to open the document. Tabs and simple explanations guide you through the signing process until you confirm the electronic signature. Then click on “Finish” to save the signed document.

Your scanned signature is not required for the electronic signature with DocuSign. But if you want your electronic signature to look like your handwritten signature, you can use the DocuSign signature function or upload a photo of your signature. Normally, however, it is sufficient to use your name. DocuSign allows you to choose between different fonts for how your name should appear on the signature stamp.

The signatory has the choice of displaying their electronic signature with a ready-made font from the DocuSign portfolio, with a touch pen on the touch screen, or with a scan of their handwritten signature. The representation of the signatory’s name in the DocuSign signature stamp in the e-signature process is due to the idea that the first and last name are part of a signature. From a legal point of view, however, it is not the stamp with the signature under the document that is binding, but the click on “Finish” on the platform. The decisive factor here is that DocuSign additionally signs the final documents and the final certificate with a digital certificate, thus ensuring that the documents cannot be changed during and after the signature process and that the transaction has taken place in accordance with the audit trail.

Additions to the signature such as i.V. or ppa. are added to the name, i.e. you must enter your name in DocuSign e.g. as “i.V. Max Mustermann” or enter it when signing.

Yes, it is possible to forward the request to sign to another person if you are not the signatory of the contract. When you open the document in DocuSign, you can use the “Assign to other person” button to assign the request to the correct person. Please do not forward the DocuSign email notification, as the recipient of the email can then sign with DocuSign using the link in your name.

Yes, at any time if you can receive your emails on the devices and an internet browser is installed. In addition, the DocuSign e-signature app allows signers to easily sign documents and view the status of the signature workflow at any time, from anywhere and on any mobile device. The DocuSign app for electronic signatures is available in the Apple App Store, Google Play and Windows Store. Signing and using the app are free of charge.
